Terms of Service

By downloading, installing, or using Shiver Me Timbers (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms apply to all users, whether using the App as a guest or with a registered account.

Shiver Me Timbers is a cold shower tracking app developed and operated by Frederick Kihle. It lets you log cold shower sessions, track your progress, participate in challenges, and optionally compete with friends. An optional paid subscription (Shiver Me Timbers Pro) unlocks additional features.

The App is available on iOS and Android. Features and availability may vary by platform and may change over time.

You must be at least 13 years old to use the App. By using it, you confirm that you meet this requirement. If you are between 13 and 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Cold showers carry inherent physical risks. By using the App you acknowledge that you take full responsibility for your own health and safety, and that you will not use the App in a way that puts you at risk of harm. If you have any medical conditions, consult a doctor before beginning a cold shower practice.

You may use the App as a guest without creating an account. If you choose to register, you are responsible for keeping your login credentials secure and for all activity that occurs under your account.

You agree to provide accurate information when creating your account and to keep it up to date. You may not create an account on behalf of someone else, or transfer your account to another person.

I reserve the right to suspend or terminate accounts that violate these Terms.

You agree not to use the App to:

• Log false or fabricated session data to gain an unfair advantage in challenges
• Harass, abuse, or behave in a threatening way toward other users in shared challenges
• Attempt to reverse-engineer, decompile, or tamper with the App
• Interfere with or disrupt the App's servers, infrastructure, or other users' access
• Use automated scripts or bots to interact with the App
• Violate any applicable laws or regulations

Violations may result in immediate termination of your account without notice.

Shiver Me Timbers Pro is an optional paid subscription that provides access to additional features. Subscriptions are managed and billed through Apple App Store or Google Play, depending on your platform.

Deleting your account does not automatically cancel an active subscription. Cancel through your app store before or after deleting your account to avoid further charges.

All content, design, code, graphics, and branding in the App are owned by Frederick Kihle and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes only.

You may not copy, reproduce, distribute, modify, or create derivative works from any part of the App without my prior written consent.

Your session logs, challenge progress, and other activity data belong to you. I store and use this data only to operate the App's features as described in the Privacy Policy. I do not claim any ownership over the data you generate by using the App.

You can export or delete your data at any time. See the Privacy Policy and the account deletion page for full details.

The App is provided "as is" and "as available" without warranties of any kind, express or implied. I do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

The App is a personal wellness tool. It does not constitute medical advice. Cold shower practice involves physical risk — you use the App entirely at your own discretion and risk.

To the fullest extent permitted by law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App. This includes but is not limited to loss of data, personal injury, or any harm resulting from cold shower practice.

Where liability cannot be excluded by law, my total liability to you shall not exceed the amount you paid for the App or subscription in the twelve months preceding the claim.

I may suspend or terminate your access to the App at any time if you breach these Terms, or for operational reasons with reasonable notice where possible. You may stop using the App and delete your account at any time.

On termination, your right to use the App ceases immediately. Sections covering intellectual property, disclaimers, limitation of liability, and governing law survive termination.

I may update these Terms from time to time. When I do, I will update the effective date at the top of this page. For material changes, I will provide notice through the App where reasonably possible. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Norway, unless mandatory local consumer protection laws in your country of residence grant you additional rights.
